What happens when I die without a Will?

If you die without making a Will you die INTESTATE. This means that an administrator, who is generally a close relative will be appointed by the courts. They will be placed in charge with managing your estate. Generally your estate is gifted to your spouse or if you don't have one, your children. In the case that you are not married or in a civil partnership, it will go to your blood relative next in line - not step children or partners. Due to the rules of Intestacy they must be a blood relative, if not spouse. If you do not have a direct blood relative or a spouse the estate will go to the Crown. Yes, marriage revokes any previous Wills. You will need to update your new Will to distribute your estate.

Can I appoint guardians for my children in my Will?

Yes. You can express who you would like to be the guardian or guardians for your children when you die. Expressing this in your Will, will ensure that the Courts are aware of your wishes for guardianship of your children.

How long does it take to make a Will?
